Our Services are intended for users in Vietnam. We make no representation that our Services are appropriate, legal, or available for use in other locations.

Medical Disclaimer

Our Services provide a platform for telemedicine consultations with licensed healthcare providers. However:

• The information provided through our Services is not a substitute for professional medical advice, diagnosis, or treatment.
• Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition.
• Never disregard professional medical advice or delay seeking it because of something you have read or heard on our platform.
• If you think you may have a medical emergency, call your doctor or emergency services immediately.

Our Services are not intended to replace your relationship with your primary healthcare provider. We do not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on our platform.

User Accounts

Registration

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding the password that you use to access our Services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.

You agree not to disclose your password to any third party. You must notify us immediately of any breach of security or unauthorized use of your account.

Account Termination

We reserve the right to terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. If you wish to terminate your account, you may simply discontinue using our Services or contact us to request account deletion.

Telemedicine Services

Nature of Services

Our telemedicine Services connect users with licensed healthcare providers for virtual consultations. These consultations are conducted via secure video, audio, or text communication through our platform.

Healthcare Providers

Healthcare providers accessible through our Services are independent professionals who are solely responsible for the services they provide. We do not employ or supervise these providers and are not responsible for their professional judgments, advice, or treatment.

All healthcare providers available through our platform are licensed in accordance with applicable laws and regulations in Vietnam.

Appointment Scheduling

Our Services allow you to schedule appointments with healthcare providers. We do not guarantee that appointments will be available at your preferred times. Scheduled appointments are subject to provider availability.

Prescriptions

Healthcare providers may, at their discretion and where legally permitted, prescribe medication through our platform. The decision to prescribe is solely at the provider's professional judgment.

We do not guarantee that a consultation will result in a prescription, refill, or specific treatment recommendation.

Medical Records

Information shared during telemedicine consultations becomes part of your medical record and is protected under applicable healthcare privacy laws and regulations.

User Responsibilities

When using our Services, you agree:

• To provide accurate, complete, and up-to-date information about your health, medical history, and current conditions
• To use the Services for legitimate healthcare needs and not for any fraudulent, illegal, or unauthorized purpose
• To respond promptly to requests for additional information from healthcare providers
• To follow up with in-person care when recommended by a healthcare provider
• To seek emergency services when appropriate instead of relying on our Services for urgent or emergency medical conditions
• Not to use our Services if you are experiencing a medical emergency
• Not to transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Not to impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Not to interfere with or disrupt our Services or servers or networks connected to our Services

Payment and Fees

Service Fees

We charge fees for certain aspects of our Services. All fees are clearly disclosed before you incur any charges. By using our paid Services, you agree to pay all fees in accordance with the pricing and payment terms in effect at the time.

Payment Methods

We accept various payment methods, including credit cards, bank transfers, and other electronic payment options. You authorize us to charge your selected payment method for all fees incurred.

Insurance

Some telemedicine consultations may be covered by health insurance. We do not guarantee insurance coverage for our Services. You are responsible for understanding your insurance benefits and for any charges not covered by your insurance.

Recurring Subscriptions

If you select a subscription plan, you authorize us to charge your payment method on a recurring basis for the subscription period you select. You may cancel your subscription at any time by contacting us or through your account settings.

Intellectual Property Rights

Our Content

Our Services and their contents, features, and functionality, including but not limited to text, graphics, logos, icons, images, audio clips, videos, and software, are owned by VietInvestMind or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms.

Restrictions

You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content, except as permitted by these Terms
• Use any illustrations, photographs, videos, or audio sequences or any graphics separately from the accompanying text
• Delete or alter any copyright, trademark, or other proprietary notices
• Access or use our Services for developing a competitive product or service

Feedback

If you provide us with any feedback, suggestions, or ideas regarding our Services, you grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use such feedback in any way.

Limitation of Liability

To the maximum extent permitted by applicable law, VietInvestMind, its affiliates, and their respective officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing or using our Services during the twelve (12) months prior to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

Disclaimer of Warranties

Your use of our Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

• The Services will meet your requirements
• The Services will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Services will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained through the Services will meet your expectations

Indemnification

You agree to defend, indemnify, and hold harmless VietInvestMind, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from your violation of these Terms or your use of the Services, including, without limitation, any use of the Services' content other than as expressly authorized by these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration in accordance with the rules of the Vietnam International Arbitration Centre (VIAC). The arbitration shall be conducted in Hanoi, Vietnam, in the Vietnamese language.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both you and VietInvestMind waive any right to a jury trial.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

The failure of VietInvestMind to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of VietInvestMind.

Entire Agreement

These Terms constitute the entire agreement between you and VietInvestMind regarding our Services, superseding any prior agreements between you and VietInvestMind (including, but not limited to, any prior versions of the Terms).
